Terms of Service

1. Acceptance of Terms

By accessing or using The Marrakech Society platform at themarrakechsociety.ma ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use our services.

2. Membership

The Marrakech Society is a concierge platform for Marrakech nightlife. Membership is earned through completed concierge bookings; your tier rises automatically with the nights we arrange.

• You must be at least 18 years old to book with The Marrakech Society
• You must provide accurate and truthful information when you book
• Membership is personal and non-transferable
• We reserve the right to revoke membership at any time for violations of these terms
• Members progress through tiers (Insider, Patron, Vanguard, Oracle) based on engagement

3. Payments

• Concierge arrangements are paid via secure Stripe payment links, settled to Jeannette Ltd (United Kingdom)
• Stripe handles card processing and invoicing on our behalf
• Each concierge arrangement is a one-time payment — there are no subscriptions or recurring charges
• Event access, table reservations, and concierge fulfilment are handled off-platform by the venues or providers and are paid directly to them, not through The Marrakech Society

4. Cancellations & Refunds

Concierge fees cover the work of arranging your night. Our cancellation policy is as follows:

• More than 48 hours before your night: Full refund of the concierge fee.
• Within 48 hours of your night: The concierge fee is non-refundable — your venue is already held and the arrangement made.
• If we can't arrange your night: If the Society cannot match your request, you receive a full refund. Tables, bottles, and drinks settled at the venue follow that venue's own cancellation policy.

5. Code of Conduct

Members are expected to uphold the standards of The Society at all times:

• Respect venue staff, other members, and guests
• Adhere to dress codes specified for each event
• Do not share or resell tickets or table reservations
• Do not photograph or record other members without consent
• Comply with all venue policies and Moroccan law

Violations may result in immediate removal from an event, membership suspension, or permanent expulsion without refund.

6. Intellectual Property

All content on the Platform — including text, graphics, logos, images, and software — is the property of The Marrakech Society or its licensors. You may not copy, distribute, modify, or create derivative works without our written permission.

7. Venue Relationships

The Marrakech Society acts as a booking platform connecting members with venue partners. We curate and vet all partner venues, but each venue operates independently. The Marrakech Society is not liable for the actions, services, or policies of individual venues beyond our platform.

8. Limitation of Liability

The Marrakech Society provides the Platform "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform, attendance at events, or interactions with venues or other members.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

10. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated to members via email or platform notification. Continued use of the Platform after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the Kingdom of Morocco. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Marrakech, Morocco.
